Bad business sense?

OK, a previous character now in jail for being a multi owes the money changer. Apparently I can't start over unless the debt to the bank is paid, but as there is no chance of that character ever being released, then why would i pay the debt?
If i started over there is an extremely high chance I'd spend money here, as it is there is zero chance.
Assuming the above is correct then surely this is bad business... What you think?
